As of October 1, 2021 a defendant has a right to a speedy trial per statute

The supreme court in Illinois had previously entered an administrative order tolling the speedy trial rights of a person charged with a criminal offense in Illinois.  Normally, a defendant has a right to a speedy trial in either 160/120 days depending if they are in custody or not.  That right was tolled until October 1, 2021.  Its still unclear if the court had the authority to enter such an order since the speedy trial right is created with a statute.  That would normally require the legislature to modify such a right.  The problem is that a defendant would have to take the matter to the US Supreme Court to have a fair hearing on whether the Illinois Supreme Court acted appropriately in this regard.  I just don't see a client having the ability to take this issue that far.  And to date, I have heard of no defendant pushing this issue.  If I receive notice that such a case exists, I will post the information.
