Today there were articles describing the over $600,000 payouts to multiple victims of sexual harassment by former St. Clair County Clerk, Mr. Delaney. The law is simple in these cases: where a person of a protected category (female) is subjected to sexual harassment AND the acts are conducted by a supervisor, the employer is strictly liable. No proof of any breach of duty or other element is necessary. The fact that there were multiple plaintiffs who all were paid is not surprising. In most similar cases, given enough time, the harasser will act out towards other female employees.
